These terms apply every time you use nesugo.com or the NESUGO application. Please read them before placing an order.
These Terms of Service (the “Terms”) are a binding agreement between you and Nesugo Labs LLC (“NESUGO”, “we”, “us”), a company registered in the United States with its registered office at 30 N Gould St, Ste R, Sheridan, WY 82801. They govern your access to the website nesugo.com, the NESUGO application and every service we provide through them (together, the “Platform”).
By creating an account, placing an order or otherwise using the Platform you confirm that you have read these Terms and agree to them. If you do not agree, please do not use the Platform.
NESUGO operates a technology platform that connects customers who need something delivered in Nha Trang, Vietnam, with independent couriers who are willing to carry out that task.
NESUGO is not a retailer, a pharmacy, a restaurant or a licensed postal operator. We do not own, produce, stock or sell the goods that couriers buy or carry on your behalf. Where a courier purchases an item for you, the sale is concluded between you and the merchant; the courier acts on your instructions and with your money.
Couriers are independent contractors. They are not employees or agents of NESUGO, and NESUGO does not direct the manner in which they perform a task beyond the standards described in these Terms.
You must be at least 18 years old and legally able to enter into a contract to use the Platform. Accounts are personal; you may not transfer or share your account.
You are responsible for the accuracy of the delivery address, contact details and order instructions you provide, and for keeping your login credentials confidential. Tell us immediately at support@nesugo.com if you believe your account has been used without your permission.
An order may be placed at a fixed price published on the Platform, or as an open request for which couriers submit their own price. An order becomes binding when a courier accepts it and you receive a confirmation in the application.
For a Buy & Bring order you authorise the courier to purchase the described items on your behalf up to the spending limit you set. If the actual price at the shop differs from the estimate, the courier will contact you before completing the purchase.
Estimated delivery times are indicative. Traffic, weather, merchant stock and the availability of couriers all affect them, and we do not guarantee a specific arrival time unless a priority service has been purchased.
Prices shown on the Platform are in United States dollars and include the NESUGO service fee unless stated otherwise. The cost of purchased goods, tolls, parking charges and any merchant surcharge are additional and are shown to you before the order is completed.
Payments are processed by licensed third-party payment providers. NESUGO does not store full card numbers. You authorise us or our payment provider to charge the payment method you select for the total amount of your order, including any agreed adjustment after the goods have been purchased.
We may place a temporary authorisation hold on your payment method for the estimated order value. Any unused amount is released once the final total is known.
You may not use the Platform to order, send or receive: narcotic drugs, psychotropic substances or related paraphernalia; prescription medicines without a valid prescription; weapons, ammunition or explosives; flammable, corrosive, radioactive or otherwise hazardous materials; live animals; human remains or biological samples; cash, bank cards, securities or bearer instruments; counterfeit, stolen or pirated goods; pornographic material; ivory, protected species or products made from them; and any item whose possession, purchase or transport is unlawful in Vietnam or in the country of the recipient.
Alcohol and tobacco may only be ordered by adults, may be refused at the courier's discretion and must be handed over in person against proof of age.
We may cancel any order that we reasonably believe breaches this section, and we may suspend or close the account of a user who repeatedly attempts to do so.
You agree to be reachable at the phone number you provided while an order is in progress, to accept the delivery at the agreed address, and to treat couriers and support staff with respect.
You must not use the Platform for any unlawful purpose, attempt to gain unauthorised access to it, interfere with its operation, scrape it by automated means, or use it to send unsolicited commercial messages.
You may cancel an order free of charge before a courier accepts it. After acceptance, cancellation rules and the refund you are entitled to are set out in our Refund & Return Policy, which forms part of these Terms.
NESUGO may cancel an order if no courier accepts it, if the requested item is unavailable, if the address cannot be reached safely, or if the order breaches these Terms. Where the cancellation is not caused by you, any amount already charged is refunded in full.
To the fullest extent permitted by law, NESUGO's total liability for any claim arising out of an order is limited to the amount you paid for that order, together with the documented value of the goods carried, up to a maximum of USD 300 per order.
We are not liable for indirect or consequential loss, loss of profit, loss of opportunity, or for delay caused by events outside our reasonable control, including weather, traffic restrictions, power or network outages, strikes and acts of public authorities.
Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud or for death or personal injury caused by negligence.
The NESUGO name, logo, website, application, text, graphics and software are owned by Nesugo Labs LLC or its licensors and are protected by intellectual property law. You receive a limited, revocable, non-exclusive licence to use the Platform for its intended purpose. You may not copy, modify, distribute or create derivative works from it without our written permission.
You may close your account at any time by writing to support@nesugo.com. We may suspend or terminate access to the Platform if you breach these Terms, if we are required to do so by law, or if we reasonably suspect fraudulent or abusive activity. Termination does not affect obligations that arose before it.
We may update these Terms to reflect changes in our services or in the law. The current version is always published on this page with the date of the last revision. If a change materially affects your rights we will notify registered users by email or in the application before it takes effect. Continued use of the Platform after that date means you accept the revised Terms.
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules.
If a dispute arises, please contact us first at support@nesugo.com: most issues are resolved within a few working days. If we cannot settle the matter informally within 30 days, it shall be submitted to the competent courts of the State of Wyoming, unless mandatory law in your country of residence gives you the right to bring proceedings elsewhere.
